Air Canada Vacations Creator Ambassador Program
Terms and Conditions

Program Overview

The Air Canada Vacations Creator Collecive Ambassador Program (the “Program”) is an application-based initiative designed to identify and collaborate with a select group of creators who align with Air Canada Vacations’ (“ACV”) brand values, audience, and content strategy.

This Program is not a contest, sweepstakes, or game of chance. Participation in the Program does not constitute an opportunity to win a prize. Creators are selected based on predefined evaluation criteria at the sole discretion of ACV. These Terms and Conditions govern the application and selection process for the Program only. The specific terms of a selected creator's participation in the Program, including deliverables, timelines, content usage rights, compensation, and benefits, will be set out in a separate written agreement between the selected creator and ACV (the "Creator Agreement").

‍

  1. Eligibility

The Program is open to legal residents of Canada who have reached the age of majority in their province or territory of residence at the time of application and who meet the application criteria established by ACV (each, an “Applicant”). Applicants must have less than 50,000 followers across all of their social media channels combined at the time of application.

Directors, employees, representatives, or agents of ACV and each of their respective parent, subsidiaries and affiliates, successors and assigns, and members of their immediate family  (parents, children, siblings and spouse, regardless of where they are domiciled) of any of the aforementioned and persons with whom any of the aforementioned are domiciled, are not eligible to participate in the Program. ACV reserves the right, in its sole discretion, to determine whether an Applicant or participant meets the eligibility requirements of this Section 2, and to disqualify any Applicant or participant, and to require forfeiture of any benefits already provided, at any time (including after selection or during a subsequent term) if ACV determines, in its sole discretion, that such person does not meet or no longer meets these eligibility requirements.

‍

  1. Program Term and Renewal

The Program is structured as an initial term of one (1) year (the "Initial Term"). At the conclusion of the Initial Term, a limited number of creators may be invited to participate in a subsequent term, based on their overall performance and alignment with ACV's brand and Program objectives.

Performance will be evaluated at the sole discretion of ACV and may include factors such as content quality, audience engagement, reach, consistency in meeting deliverables, and overall collaboration throughout the Program.

Creators whose content demonstrates strong audience reach and shareability, including the ability to reach audiences beyond ACV's existing audience, may be prioritized for renewal consideration.

Participation in any subsequent Program term is not guaranteed. Prior participation in the Program, including in the Initial Term, does not create any entitlement, expectation, or vested right to renewal, and ACV is under no obligation to provide reasons for, or any form of compensation in connection with, a decision not to invite a creator to participate in a subsequent term.

‍

  1. Application Process

To be considered for the Program, Applicants must complete and submit the official application form during the designated application period October 28 9:00am EST – November 10 at 11:59am EST.

All required fields, materials, and supporting content (collectively, the “Application”) must be fully completed and submitted in accordance with the Program requirements in order to be eligible for consideration.

Applications that are incomplete, inaccurate, submitted outside of the application period, or do not comply with these Terms and Conditions may be excluded from consideration at the sole discretion of ACV. ACV reserves the right, in its sole discretion and without liability, to extend, shorten, or close the application period, or to modify the Application requirements, at any time and without prior notice. Applicants are solely responsible for the timely submission of their Application and for any costs or expenses incurred in preparing or submitting an Application, whether or not selected.

‍

  1. Selection Process

Applications will be evaluated by ACV based on a set of predefined criteria, which may include, but are not limited to:

  • Quality, originality, and storytelling strength of content
  • Demonstrated travel experience and destination diversity
  • Audience reach, engagement, and relevance
  • Alignment with ACV’s brand values and audience
  • Planned or anticipated travel during the Program period

Up to five (5) creators may be selected to participate in the Program per term, inclusive of any creators renewing from a prior term.

Selection is not based on chance. All decisions made by ACV in relation to the selection of Applicants are final and binding in all respects and are not subject to appeal. ACV is under no obligation to disclose the relative weighting or application of any evaluation criteria, or to provide reasons for any selection decision.

‍

  1. Notification of Selected Applicants

Selected Applicants as per the Terms and Conditions will be contacted privately using the contact information provided as part of their Application. The selected Applicant must confirm acceptance within five (5) business days of contact. At its entire discretion, ACV may select another Applicant among the Applications.

ACV is not responsible for any failure of delivery of notifications due to incorrect, incomplete, or inactive contact information provided by Applicants. Notice will be deemed given by ACV upon transmission of the communication to the contact information provided in the Application, regardless of whether it is actually received, opened, or read by the Applicant.

Only selected Applicants will be contacted. ACV is under no obligation to provide feedback or additional information to Applicants who are not selected.

‍

Participation and Program Expectations

Participation in the Program is voluntary and does not constitute employment, partnership, or joint venture with ACV.

Selected creators will be required to enter into a Creator Agreement with ACV outlining the specific terms of their participation, including deliverables, timelines, content usage rights, and any compensation or benefits. A selected creator's participation in the Program is conditional upon execution of the Creator Agreement. Until a Creator Agreement is executed, no obligations, compensation, or benefits related to participation in the Program will arise for either party. If a selected creator does not execute the Creator Agreement within the timeframe specified by ACV, ACV may, in its sole discretion, revoke the selection and select another Applicant.

ACV reserves the right to remove any participant from the Program at any time, with or without cause, in its sole discretion, including if they fail to meet Program expectations, breach these Terms and Conditions or the Creator Agreement, or engage in conduct deemed inappropriate or inconsistent with the brand. The terms governing the consequences of removal, including any entitlements or forfeitures, will be set out in the Creator Agreement.

‍

  1. Aeroplan Creator Incentive

As part of the Program, a performance-based incentive opportunity (the “Aeroplan Creator Incentive”) will be made available exclusively to creators selected to participate in the Program. The Aeroplan Creator Incentive is awarded solely on the basis of merit and objective performance criteria, and is not a contest, sweepstakes, lottery, or game of chance.

At the conclusion of the first year of the Program, the one (1) participating creator who achieves the highest cumulative content impressions across all required deliverables during the Program term, as measured and determined by ACV in its sole discretion, will receive 100,000 Aeroplan points.

In the event of a tie or dispute regarding cumulative impressions, ACV will determine the recipient in its sole discretion, and such determination will be final and binding. ACV reserves the right, in its sole discretion and without liability, to modify, substitute, postpone, or cancel the Aeroplan Creator Incentive, in whole or in part, at any time and for any reason, without prior notice. Aeroplan points have no cash value, are not transferable except as permitted by the Aeroplan program, and are subject to the terms and conditions of the Aeroplan program in addition to these Terms and Conditions.

The Aeroplan Creator Incentive is separate from the Program application process and does not form part of the initial selection of Program participants. The specific terms and measurement methodology applicable to the Aeroplan Creator Incentive will be set out in the Creator Agreement.

‍

  1. Intellectual Property and Content Usage

By submitting an Application, Applicants grant ACV a non-exclusive, royalty-free, worldwide right and license to review, evaluate, reproduce, and use the submitted Application materials solely for the purpose of administering, evaluating, and promoting the Program and any future application cycles. This license survives regardless of whether the Applicant is selected. ACV is under no obligation to use any submitted materials.

The terms governing content usage rights for any content created during a selected creator's participation in the Program, including any license grant, moral rights waiver, and attribution obligations, will be set out in the Creator Agreement.

‍

  1. Compensation and Benefits

The compensation structure, including eligibility for monthly travel rewards in the form of Air Canada eGift Cards, deliverables-based distribution, and any additional benefits, will be set out in the Creator Agreement. No compensation or benefits related to participation in the Program will arise under these Terms and Conditions.

‍

  1. Personal Information

By submitting an Application, Applicants consent to the collection, use, and disclosure of their personal information by ACV for the purposes of administering the Program, evaluating applications, and communicating with Applicants. Personal information will be handled in accordance with applicable privacy laws and Air Canada Vacations’ Privacy Policy.

  1. Applicants acknowledge and agree that, as part of the Application evaluation process, ACV may use automated tools or artificial intelligence technologies in combination with human review to assist in reviewing, processing, or assessing Applications for eligibility, completeness, and alignment with Program criteria. All final selection decisions about Applicants will be made based on human review and at the sole discretion of ACV. ACV makes no representation or warranty as to the outcome of any automated or AI-assisted assessment, and the use of such tools does not guarantee selection or any particular result. No Applicant will have any claim against ACV arising from the use of such tools.

Please see the ACV Privacy Policy for more information on our privacy practices, your personal information rights and how to exercise them, and how to contact us with further questions or concerns about how we handle your personal information.

‍

  1. Right to Modify or Cancel the Program

ACV reserves the right, at its sole discretion, to modify, suspend, or cancel the Program, in whole or in part, at any time and for any reason, without prior notice.

ACV further reserves the right to reject any Application or disqualify any Applicant or participant, at any time (including retroactively and after any compensation or benefits have been provided), who does not comply with these Terms and Conditions or who engages in conduct that may harm the reputation of ACV. A disqualified Applicant or participant will forfeit any right to further compensation or benefits under the Program and, where ACV determines it appropriate in its sole discretion, may be required to return or reimburse the value of any benefits already provided.

‍

  1. Limitation of Liability

By applying to the Program, Applicants (collectively, "Releasing Parties") agree to release and hold harmless ACV and its and their respective parent, subsidiaries, affiliates, successors, assigns, contractors, and licensees, as well as their respective directors, officers, employees, and agents (collectively, the "Released Parties"), from and against any and all claims, damages, liabilities, costs (including reasonable legal fees), or expenses arising out of or in connection with the application and selection process, including ACV's review, evaluation, or use of Application materials and any decision to select or not select an Applicant, except to the extent caused by the gross negligence or wilful misconduct of the Released Parties, and except to the extent such release is not permitted under applicable law.
To the maximum extent permitted by applicable law: (i) in no event will the Released Parties be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, goodwill, or data, arising out of or in connection with the application and selection process, whether based in contract, tort, or otherwise, even if advised of the possibility of such damages; and (ii) the aggregate liability of the Released Parties arising out of or in connection with the application and selection process will not exceed CAD $100.
Nothing in this Section 14 limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for personal injury or death that cannot be excluded as a matter of Quebec public order.
The limitation of liability and release provisions applicable to a selected creator's participation in the Program will be set out in the Creator Agreement.

  1. Governing Law

These Terms and Conditions are governed by the laws of the Province of Quebec and the applicable laws of Canada. Any disputes arising in connection with the Program shall be subject to the exclusive jurisdiction of the courts located in Montreal, Quebec.
